1. Acceptance of Terms
By accessing or using any MapMyCrop service — including mapmycrop.com, the MapMyCrop Platform API, the MapMyCrop mobile applications, or any related enterprise product — you agree to be bound by these Terms of Service (“Terms”). These Terms are entered into with Hardcastle Agrotech Solutions Inc, doing business as MapMyCrop and headquartered in New York, USA (“MapMyCrop”).
If you are entering into these Terms on behalf of a company or organization, you represent that you have the authority to bind that entity, in which case “you” refers to that entity. If you do not agree to these Terms, do not use the services.
2. Definitions
- “Services” — the MapMyCrop platform, APIs, mobile apps, websites, and any related software provided by MapMyCrop.
- “Customer” — any individual or organization that has entered into a subscription agreement or order form with MapMyCrop.
- “End User” — any individual who uses the Services through a Customer’s account (e.g., a farmer using a white-labeled mobile app).
- “Customer Data” — data uploaded to or processed by the Services on behalf of a Customer (field boundaries, farmer records, etc.).
- “AI Outputs” — any analytics, predictions, classifications, or other results generated by the Services.
3. Account & Registration
To access most features of the Services, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and credentials
- Notify MapMyCrop promptly of any unauthorized account use
- Accept responsibility for all activities under your account
MapMyCrop reserves the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
4. License & Permitted Use
Subject to your compliance with these Terms and timely payment of fees, MapMyCrop grants you a non-exclusive, non-transferable, revocable license to:
- Access and use the Services for your internal business purposes
- Integrate the Services with your systems via our documented APIs
- Share AI Outputs with your End Users as part of your products or services
You may not redistribute, resell, or sublicense the Services or AI Outputs as a standalone product.
5. Prohibited Use
You may not use the Services to:
- Violate any applicable law, regulation, or third-party right
- Upload malicious code, attempt to breach security, or disrupt the Services
- Reverse engineer, decompile, or attempt to extract source code (except as permitted by law)
- Use AI Outputs to make binding decisions about individuals without human review (where required by law, including the EU AI Act)
- Scrape, harvest, or bulk-download data outside documented API limits
- Misrepresent the source, accuracy, or methodology behind AI Outputs
- Use the Services in any manner that could damage MapMyCrop’s reputation or competitive position
6. Subscription, Fees & Billing
Access to the Services is provided on a subscription basis as set out in your order form. Unless otherwise specified:
- Subscription fees are billed annually in advance
- Usage-based fees (e.g., API calls, hectares monitored) are billed monthly in arrears
- Fees are non-refundable except as required by law
- Late payments accrue interest at 1.5% per month or the maximum permitted by law
- MapMyCrop may suspend service for accounts more than 30 days past due
MapMyCrop may update pricing with 60 days’ written notice for the next renewal term.
7. Intellectual Property
MapMyCrop retains all rights, title, and interest in and to the Services, including all underlying software, AI models, methodologies, trademarks, and documentation.
You retain all rights, title, and interest in and to your Customer Data. You grant MapMyCrop a worldwide, non-exclusive license to use Customer Data as necessary to provide the Services and as described in our Privacy Policy.
Feedback you provide may be used by MapMyCrop without restriction or compensation.
8. Customer Data & Privacy
MapMyCrop’s Privacy Policy (available at mapmycrop.com/privacy-policy/) governs how we collect and use personal data. By using the Services, you agree to that policy.
Where Customer Data includes personal data of End Users, you represent that you have a lawful basis to provide that data to MapMyCrop for processing under these Terms.
9. AI Outputs & Accuracy
MapMyCrop’s Services generate AI Outputs including vegetation indices, yield forecasts, severity scores, and other analytics. While we strive for high accuracy, AI Outputs:
- Are based on satellite data, weather data, and agronomic models with inherent uncertainty
- Should not be used as the sole basis for binding decisions affecting individuals
- Should be reviewed by qualified personnel before being used for insurance claims, credit decisions, regulatory disclosures, or other high-stakes applications
- May be updated, corrected, or recalculated as new data becomes available
10. Warranties & Disclaimers
MapMyCrop warrants that the Services will be performed in a professional and workmanlike manner consistent with industry standards.
Except as expressly stated, the Services are provided “as is” and “as available.” To the maximum extent permitted by law, MapMyCrop disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
MapMyCrop does not warrant that the Services will be uninterrupted, error-free, or that AI Outputs will meet your specific requirements.
11. Limitation of Liability
To the maximum extent permitted by law, MapMyCrop’s total cumulative liability arising out of or related to these Terms shall not exceed the greater of:
- The fees paid by you to MapMyCrop during the 12 months preceding the event giving rise to liability, or
- USD $100,000
In no event shall MapMyCrop be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, customers, or data.
12. Indemnification
You agree to indemnify and hold harmless MapMyCrop from any third-party claims arising out of:
- Your use of the Services in violation of these Terms
- Your Customer Data, including any personal data you provide
- Your use of AI Outputs in decisions affecting third parties
13. Term & Termination
These Terms remain in effect for the duration of your use of the Services. Either party may terminate:
- For convenience, at the end of the then-current subscription term, with 30 days’ written notice
- For cause, immediately upon written notice if the other party materially breaches these Terms and fails to cure within 30 days
Upon termination, your right to use the Services ends. Sections 7 (IP), 8 (Data), 11 (Liability), 14 (Law), and 15 (Changes) survive termination.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. Any disputes shall be resolved exclusively in the state and federal courts located in New York, New York, USA, except that MapMyCrop may seek injunctive relief in any competent jurisdiction to protect its intellectual property.
For Customers domiciled in the EU, mandatory consumer protection laws of your home country remain unaffected.
15. Changes to Terms
MapMyCrop may update these Terms from time to time. Material changes will be communicated via email to active Customers at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
